Forexx B.V. is an organization that brings together candidates and employers. To do this, Forexx B.V. holds personal data from both candidates and employers/clients. Forexx B.V. guarantees careful and discreet handling of this personal data, taking into account the interests of all parties involved. Forexx B.V. also takes the utmost care to safeguard the privacy of visitors to its website. You are welcome to visit the website and review its content as often as you wish, without obligation. This Privacy Statement describes which personal data Forexx B.V. collects and for what purpose. The personal data is handled and secured with the utmost care, in accordance with legal requirements, including the General Data Protection Regulation (EU Regulation 2016/679).
Why do we collect your personal data?
We process your personal data for the execution of our services, including mediation, secondment, recruitment & selection, personal development and employability, and payroll administration.
More specifically, your personal data is processed to:
- Verify your identity.
- Make you offers and/or provide information about our services and other activities, and to better align these with your wishes and qualities. This is done by our employees and partly automated (for example, a vacancy information service).
- Assess your suitability and availability in connection with mediation for permanent or temporary work or an assignment, which may also involve test results, reference checks, social media (if relevant to the position and indicated in the job description), etc.
- Establish and maintain an employment or personnel/mediation relationship with you and carry out relevant administration.
- Record an assignment with the client in an agreement and maintain and fulfill the agreement with the client.
- Promote your personal development and employability, including training, education, and testing.
- Contact you and respond to your questions.
- Complete your request for information and handle complaints.
- Management purposes, including management information, internal controls, company security, and conducting audits and accounting checks.
- Quality purposes such as certification.
- Apply for subsidies, premium discounts, etc.
- In case of an employment relationship with you and compliance with laws and regulations, including but not limited to identification, labor law, tax and social security law, combating fraud, and national and international sanctions legislation.
- Contact you regarding participation in a competition and/or events.
On what grounds do we process personal data?
To use personal data, we need a legal basis under the General Data Protection Regulation.
We use the following bases:
- You have given Forexx B.V. explicit consent.
- The use is necessary to perform or enter into an agreement with you.
- The use is necessary to comply with a legal obligation.
- In emergencies: the use is necessary to protect your vital interests or those of another person.
- We have a legitimate interest in the use, unless your interest or the interest of a third party regarding privacy outweighs this.
Forexx B.V. may rely on the following legitimate interests:
- Protecting your safety.
- For quality and training purposes.
- Improving IT management and security.
- Analyzing and improving our services and website content.
- Improving, adapting, supporting, researching, and analyzing our services.
- Promoting the quality and safety of our services.
- Communicating with you and other Forexx B.V. relations.

When do we collect your personal data?
We collect your personal data from the moment you enter or leave your personal data on our website, or otherwise register or are registered to use our services.
We may also collect personal data if you have posted it on public sources (such as job boards like LinkedIn, Monster, etc.) indicating you may be interested in work-related services. In that case, we may contact you to see if you are interested in registering with us, in accordance with our terms and this Privacy Statement.
Which personal data do we record?
We process the personal data necessary for our services. Some of this data is required to use our services. Additional data may be desirable to better tailor the service to your wishes and qualities or to meet more specific requests or obligations from clients. You are responsible for the accuracy and relevance of the data you provide. If you are not interested, we will honor your wish not to be contacted.
Forexx B.V. generally does not process special categories of personal data (such as data about race, religion, beliefs, health, political preference, union membership, genetic data, biometric data, criminal activities, sexual life, criminal personal data), unless necessary to comply with legal obligations.
More specifically, this includes (documents with) the following personal data:
If you want to be or have been mediated (candidates):
- Name, address, postal code, city, email address, and other contact details
- Date of birth, age, gender
- Cover letter, Curriculum Vitae (CV), information about education, internships, and work experience
- Information about training and education
- Other information that may be relevant in assessing suitability, such as references and testimonials
Additionally, if you work for/are going to work for/have worked for Forexx B.V.:
- Nationality, citizen service number (BSN), ID proof, work permit
- Other data related to personnel, salary, and absence administration
- Assignment-related statements such as, but not limited to, Certificate of Good Conduct (VOG), WFT, and PES
If you are a business relation of FOREXX B.V. (client/supplier):
- Forexx B.V. processes personal data of persons working for companies we do business with. This communication concerns making offers, providing information about our services, maintaining a business relationship, and concluding and maintaining an assignment agreement. To this end, Forexx B.V. processes:
- Name, position, telephone, email address, and other contact details
- Relevant information about the organization with which business is conducted
With whom can we share your personal data?
We only share your personal data with third parties if necessary because third parties perform work on behalf of Forexx B.V. and only for the purposes described in this Privacy Statement. If a third party is engaged, Forexx B.V. ensures that this third party maintains the same level of security and confidentiality as we do. Forexx B.V. remains responsible for the processing of personal data. Forexx B.V. enters into agreements with third parties to ensure your data is well secured.
Forexx B.V. may, in case of a merger, acquisition, or sale of (part of) its organization, share your personal data with a third party, such as a potential buyer or seller. We will inform you of this via email and/or a clearly visible notification on the website and inform you about your rights in this situation.
If you want to be or have been mediated (candidates):
- Forexx B.V. may share your personal data within the entities belonging to Forexx B.V., its clients, suppliers (such as data processors of CVs) who provide services or perform assignments on its behalf, government agencies, and other business relations. Also, in all other cases where we may be required to do so, for example by court order or judgment.
If you work for/are going to work for/have worked for Forexx B.V.:
- The same applies as for you as a candidate.
- The provision of personal data is based on a legitimate interest, legal obligation, and/or for the execution of the agreement in accordance with the purposes stated under "Why do we collect your personal data?"
If you are a business relation of FOREXX B.V. (client/supplier):
- Forexx B.V. may transfer personal data obtained from its business relations if necessary for achieving the objectives of the business relationship or for mediation. These data may be transferred within the entities of Forexx B.V., to applicants or candidates, business partners, and subcontractors (such as data processors) who provide services on its behalf, and in all other cases where Forexx B.V. may be required to do so, for example by court order or judgment.
How long do we retain your personal data?
Retention periods vary depending on the nature of the service provided and the applicable legal retention periods. Forexx B.V. never retains personal data longer than necessary for the purpose of processing. Forexx B.V. retains your personal data as long as we deem necessary to provide services, enable you to use the website, comply with applicable laws, resolve disputes, and otherwise as necessary to conduct our business activities.
If you work for/are going to work for/have worked for Forexx B.V.:
- Your personal data is available for (re)mediation up to two years after the end of employment.
- Certain personal data, for example for claims, audits, and tax obligations, are retained longer according to legal retention periods. However, these data are only accessible to Forexx B.V. employees to a limited extent.
If you are a business relation of FOREXX B.V. (client/supplier):
- The name and contact details are retained as long as they are relevant for the purpose for which they were recorded. Business contact details will be updated or deleted if they are no longer relevant.
What are your rights?
- You have the right to request access to all personal data we process about you. However, requests for access that are clearly made with the intention of causing nuisance or harm to us will not be processed.
- You have the right to request that any personal data about you that is incorrect or inaccurate be corrected free of charge. If such a request is made, you must also provide proof that the data to be corrected is incorrect.
- You have the right to withdraw your previously given consent for the processing of personal data. You can withdraw your consent at any time by sending an email to info@forexx.nl.
- You have the right to request that your personal data be deleted if you withdraw your consent for its processing. However, please note that a request for deletion will be assessed in light of legal or regulatory obligations or administrative or judicial orders that may prevent us from deleting the relevant data.
- Instead of deletion, you may also request that we restrict the processing of your personal data if (a) you dispute the accuracy of that data, (b) the processing is unlawful, or (c) the data is no longer needed for the stated purposes, but you need it to defend yourself in legal proceedings.
- You have the right to object to the processing of personal data if you can demonstrate that there are serious and legitimate reasons related to special circumstances justifying such objection. However, if the intended processing is considered direct marketing, you have the right to object to such processing free of charge and without justification.
- When your personal data is processed based on consent or a contract and the processing is carried out by automated means, you have the right to receive the data you have provided to us in a structured, commonly used, and machine-readable format and, if technically possible, the right to transfer this data directly to another service provider. The technical feasibility of this is determined solely by us.
- You have the right to data portability. The right to have personal data transferred to another party.
- The right to request not to be subject to a decision based solely on automated processing.
Security
Forexx B.V. does everything possible to optimally secure your personal data against unlawful use. We do this through appropriate physical, administrative, organizational, and technical measures. For example: only authorized persons have access to the data. If and insofar as data is provided to data processors who provide services or carry out assignments on our behalf, a processing agreement is concluded with Forexx B.V., stipulating that they must also optimally secure the personal data. Access by our staff or staff of our external processors is also subject to strict confidentiality obligations.
Where do we process data?
We and our external processors will only process your identifiable personal data outside the European Economic Area (EEA) if there is a legitimate basis for doing so.
If such a transfer takes place, we will ensure that appropriate safeguards are in place to guarantee the security and integrity of your personal data. All rights regarding personal data that you may enjoy under applicable mandatory law are guaranteed, and the necessary legal protection mechanism is implemented.
Automated decision-making
Forexx B.V. may, if necessary, make decisions based on automated processing that can have (significant) consequences for you. These are decisions made by computer programs or systems, without a person (for example, a Forexx B.V. employee) being involved. Example: in case of suspected fraudulent activities, we may block you from using our websites.
